 A bill to amend 1967 PA 150, entitled

“Michigan military act,”

by amending section 411 (MCL 32.811), as amended by 2000 PA 472.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

Sec. 411. (1) A person An individual who has completed not less than 20 years of active service with the national guard or defense force, or both, may retire and receive retirement pay under 1 or more of the following circumstances:

(a) Attainment of 62 years of age.

(b) Ineligibility, because of federal law or regulation, for further federal recognition in the person’s individual’s current grade because of age or length of service, and termination of the person’s individual’s commission or enlistment in the national guard National Guard of the United States.

(c) Withdrawal of the person’s individual’s federal recognition and termination of the person’s individual’s commission or enlistment in the national guard National Guard of the United States because of physical disqualification from further service.

(d) Separation from the national guard or defense force under an honorable circumstance.

(2) A person An individual who retires under subsection (1)(a) shall must receive pay of $600.00 $900.00 per year. A person An individual who retires under subsection (1)(b), (c), or (d) shall must receive pay of $600.00 $900.00 per year upon on reaching 55 years of age.

(3) Upon On the death of a person an individual who has completed not less than 20 years of active service with the national guard or defense force, or both, and who before his or her the individual’s death met 1 of the circumstances described in subsection (1)(b), (c), or (d), or was still in active service, a surviving spouse shall receive $500.00 $800.00 per year until death.

(4) Beginning January 1, 2025, the department of treasury shall adjust the dollar amounts in this section by an amount determined by the state treasurer at the end of the preceding calendar year to reflect the cumulative annual percentage change in the Consumer Price Index. As used in this subsection, “Consumer Price Index” means the most comprehensive index of consumer prices available for this state from the Bureau of Labor Statistics of the United States Department of Labor.
