A bit of legislative news this week. We have one bill in The Oklahoma Legislature that proposes the creation of The Oklahoma State Guard. Also we have a number of previous bills we reported on in The Oregon & Texas legislatures that provide additional benefits to State Defense Force troops.
A new bill known as The “Oklahoma State Guard and Militia Revitalization Act of 2023,” proposes the creation of the Oklahoma State Guard (OSG) as part of the state’s militia. The bill aims to modify participation requirements, establish OSG units, and ensure prompt response from specific members. The bill addresses the responsibilities and funding of county units, requires the development of an emergency management coordination plan with county sheriffs, and makes amendments to existing laws pertaining to the Oklahoma State Guard Act, including appointment procedures and training authorizations. The bill is currently in the introductory stage with a target effective date of November 1, 2023.

Moving on to Oregon.
House Bill 2574, currently in the Oregon legislature, addresses the right of action for individuals injured by paramilitary activity. It expands the definition of “civil disorder” in relation to the crime of unlawful paramilitary activity and establishes a right of action for those harmed by such activities. The bill grants the Attorney General the authority to bring civil action seeking injunctive relief against paramilitary activity and allows the use of investigative demands during investigations into paramilitary activity, with specified exceptions.
Senate Bill 994 modifies the appointment criteria for temporary Assistant State Judge Advocates within the organized militia. It changes the eligibility from officers of the organized militia to members of the organized militia who are in good standing with the Oregon State Bar. The bill also removes the authority of the Adjutant General to appoint State Judge Advocate Legal Assistants.

Lastly The Texas State Guard had a multitude of bills that passed and were signed into law. We also uncovered a new bill that would assist Texas State Guard members who suffer economic hardship while on Active Duty.
We updated the following bills:
Senate Bill 371 pertains to the Texas Armed Services Scholarship Program. It requires students receiving the scholarship to enter into an agreement with the board, which includes committing to a four-year term as a member of the Texas Army National Guard, Texas Air National Guard, Texas State Guard, United States Coast Guard, or United States Merchant Marine, or serving as a commissioned officer in any branch of the U.S. armed services.
Senate Bill 538 addresses the use of appropriated money by the Texas State Guard for recruiting and retention purposes. The bill allows the Texas State Guard to utilize appropriated funds for recruiting and retaining service members, employees, and other personnel, without prohibiting such use.
House Bill 1192 is related to the Texas Armed Services Scholarship Program. It establishes similar requirements for scholarship recipients, including the commitment to a four-year term as a member of the Texas Army National Guard, Texas Air National Guard, Texas State Guard, United States Coast Guard, or United States Merchant Marine, or a contract to serve as a commissioned officer in any branch of the U.S. armed services.
We also added a new bill from The Texas Legislature:
Senate Bill 424, which is currently in the Texas Legislature, relates to supplemental pay for members of the Texas military forces who experience economic hardship due to military duty. The bill expands the eligibility for supplemental pay to now include members of the Texas State Guard.
